The Build-Out Nobody Voted On
The shift from car phones to mainstream mobile service in the 1990s forced carriers to build infrastructure at a pace no zoning board had planned for. Towers went up fast, and they went up bare — lattice steel and monopoles, dropped into subdivisions, ridgelines, and historic districts with little local input. The reaction was immediate and, in many towns, organized.
Three Fault Lines
Health anxiety. Cellular RF exposure was new enough that residents had little to go on. The Telecommunications Act of 1996 reshaped the fight. Section 704 of the Act bars state and local governments from regulating wireless facility placement on the basis of the environmental effects of RF emissions, as long as the facility complies with FCC limits. In practical terms, a town could not legally deny a tower permit because residents feared radiation — doing so invited a federal lawsuit the locality would likely lose.
How Towns Fought Back Without Health Arguments
Local governments learned where the law still left room to maneuver.
Setback and proximity ordinances. Boca Raton's commissioners, after losing an appeal over the school-site tower, passed a tighter ordinance barring cell sites within 500 feet of residentially zoned property — a distance rule, not a health rule, and therefore defensible.
Aesthetic and historic-character arguments. Where a tower could be shown to damage the visual character of a protected district, towns had a legal foothold the Act did not foreclose.
Stealth siting. Industry's own response to sustained local pressure was the camouflaged tower — monopines, flagpoles, clock towers, and faux steeples designed to blend in rather than fight the zoning board outright.
A Second Wave: The Internet's Own Backlash
The internet's physical buildout — fiber trenching, DSL and cable plant, and later the data centers that hosted it — produced a quieter version of the same fight. Trenching disputes over public right-of-way access, franchise battles between cable providers and municipalities, and early concern over the visual and noise footprint of telecom equipment cabinets echoed the tower fights almost exactly, just with less mobilization. The reason was structural, not cultural: broadband infrastructure was mostly invisible once buried, and the resource draw on a community — some right-of-way disruption, some equipment cabinets — was trivial next to what a cell tower or a data center demands. The public had no reason to organize against something it would never see or feel.
The Third Wave: Data Centers Bring the Fight Back, Harder
Data centers have revived the cell-tower-era reflex at a scale the 1990s never saw. By the first months of 2026, more than 75 data center projects worth roughly $130 billion had been blocked or delayed nationally — matching the total for all of 2025 in a single quarter. Active opposition groups grew from 396 at the end of 2025 to 833 by March 2026, spanning 49 states. Public opposition to a data center built near one's home rose from roughly half of Americans in late 2025 to about 70 percent within a few months.
Same Mentality, Three Consistent Threads
The invisible threat, made visible. 1990s residents feared RF radiation they could not see or measure. Today's residents cite electricity rate hikes and water depletion they similarly cannot directly observe until the utility bill or the well runs differently. In a March 2026 Quinnipiac poll, 72 percent of respondents cited electricity cost as their leading concern and 64 percent cited water — concrete, but still abstract enough to drive the same anxious organizing pattern as the radiation fear of 1997.
Distrust of the builder, not just the structure. In 1996, the adversary was the telecom carrier negotiating around local zoning. In 2026, it is the hyperscaler — Amazon, Google, Meta, Microsoft, or OpenAI — perceived as extracting local resources while delivering thin local benefit. One Virginia county board chair accused a hyperscaler of hiring investigators to dig up dirt on opposition members and said the county was “ready to go to war” — language with a direct lineage to the original guerrilla-fight framing of the tower era, this time aimed at a trillion-dollar industry instead of a regional carrier.
Bipartisan opposition that crosses the usual lines. Cell tower resistance in the 1990s was never a partisan fight — it was a property-and-health fight that crossed every demographic. Data center opposition shows the identical pattern: a 2026 Quinnipiac poll found 78 percent of Democrats, 66 percent of independents, and 56 percent of Republicans opposed, with Democrats emphasizing environmental and water impact and Republicans emphasizing tax incentives, grid strain, and property values. Different vocabulary, same coalition shape.
Where the Pattern Breaks
The one structural difference matters more than the similarities. Section 704 of the Telecommunications Act gave carriers a federal trump card: towns could not block a tower on health grounds, full stop, which is why the 1990s fight ultimately settled into stealth siting rather than outright bans. No equivalent federal preemption protects data centers. Zoning, water allocation, and electricity rate-impact review remain squarely local and state authority. That is the legal reason data center moratoria are actually sticking — at least a dozen states have introduced construction moratoriums, and New York passed a one-year pause on large permits — where the equivalent 1990s tower moratoria were always a stalling tactic against a fight local government was structurally guaranteed to lose.
The Pattern Repeats
Across three decades and three technologies, the public reflex has been the same: organize fast against unfamiliar infrastructure that arrives without local consent, frame the objection around health or resource fears that are real but hard to quantify, and force the builder to either disguise the footprint or negotiate real local concessions. Cell towers learned to hide as trees. The internet's physical plant mostly hid by being buried and small. Data centers cannot hide — they are visibly enormous, and the resources they draw are not abstract once a community sees its rates rise or its water table strained. That visibility, paired with the absence of a Section-704-style legal shield, is why this third wave is moving faster and landing harder than the first one did.
